TPS APPLICATIONS HAVE STARTED!!! (January 21st, 2010 until July 21st, 2011)


Pursuant to the earthquake which ravaged the Country of Haiti on January 12th, 2010, Secretary of Department of Homeland Security, Janet Napolitano, announced on Friday, January 15th, 2010 that the Obama Administration granted TPS (Temporary Protective Status) to all Haitian nationals residing in the United States on or before January 12th, 2010.

Having been created by Congress through the Immigration Act of 1990, TPS is a temporary immigration status granted to eligible nationals of a country that the US Government has designated for TPS because the country is experiencing an ongoing armed conflict, an environmental disaster, or extraordinary and temporary conditions. TPS offers many benefits including the ability for said nationals to continue living in the U.S., to legally be able to work in the U.S., as well as obtain their Driver�s License and Social Security Card. Although TPS is only valid for a period of 180 days, TPS Applicants have the option for renewal based upon the ongoing conditions of the country. To be eligible for TPS, an individual must meet the following requirements:

  • Be a national of Haiti, or a person without nationality who last habitually resided in Haiti;
  • Have continuously resided in the U.S. since January 12th, 2010;
  • Have been continuously physically present in the U.S. since the date of the Federal Register Notice Publication;
  • Meet certain immigrant admissibility requirements and other TPS eligibility requirements, and
  • Satisfactorily complete all TPS application procedures and registration.

Note: TPS Applicants must make careful considerations when applying for TPS. It is important to file properly and by the mandated deadline. If not done in accordance with the U.S. Government guidelines, you may lose your chance to benefit from TPS. It is important to retain the services of an attorney experienced in immigration law in order to ensure that filing is done properly and on a timely basis.
